el impacto de las videoconferencias en la experiencia del encarcelamiento

Resumen

El creciente uso de audiencias remotas en los procedimientos penales ha generado un intenso debate sobre su impacto en los derechos procesales de sospechosos, acusados ​​y acusados, así como sobre la necesidad de un nuevo marco normativo para un juicio justo en dichas audiencias. El artículo sostiene que existe una laguna en el debate en relación con dos aspectos: la tendencia hacia el uso sistemático y generalizado de audiencias remotas en casos que involucran a presos con fines administrativos y el hecho de que dicho uso sistemático y generalizado tiene un impacto restrictivo en los regímenes penitenciarios y, en consecuencia, en los derechos fundamentales de los presos. Asimismo, propone el establecimiento de normas básicas para el desarrollo de un marco normativo sobre el uso de audiencias remotas en los procedimientos penales que involucran a presos, basado en el principio de normalización y las normas conexas desarrolladas en el marco del Derecho Internacional de los Derechos Humanos.
