Audiências virtuais e os direitos fundamentais das pessoas presas
o impacto das videoconferências na experiência do encarceramento

O uso crescente de audiências virtuais em processos penais produziu um debate prolífico sobre seu impacto nos direitos processuais dos réus, bem como sobre a necessidade de um novo quadro normativo sobre o processo justo (fair trial) em audiências remotas. O artigo sustenta que existe uma lacuna no debate no que tange a dois aspectos da questão, a saber: a existência de uma tendência ao uso sistemático e generalizado de audiências remotas em casos envolvendo pessoas presas, para fins gerenciais; e o fato de que o uso sistemático e generalizado de audiências remotas envolvendo pessoas presas produz um impacto restritivo nos regimes penitenciários e, consequentemente, nos direitos fundamentais das pessoas presas. O artigo também propõe o estabelecimento de regras básicas para o desenvolvimento de um arcabouço normativo sobre o uso de audiências remotas em processos penais envolvendo pessoas presas, com base no princípio da normalização e em normas correlatas desenvolvidas no âmbito do Direito Internacional dos Direitos Humanos.
