Legal Pragmatism and Deconstruction in the Fight against International Trafficking in Women

Abstract

This article examines the regulatory nature of the Brazilian criminal system through the lens of public policies aimed at combating international trafficking in women for sexual exploitation. The theoretical framework draws on the dialogue between Richard Rorty's pragmatism and Jacques Derrida's deconstruction, grounding the research within Critical Legal Studies. Employing inductive reasoning and jurimetrics, the study analyzes quantitative data from Brazil's National Reports on Trafficking in Persons (2005-2016), the U.S. Department of State's Trafficking in Persons Reports (2001-2018), and the Polaris Project (2017). The comparative analysis between Brazil and the United States reveals that criminal decisions follow a public policy rationale, guided by administrative principles such as legality, efficiency, and transparency, rather than a merely punitive selectivity. Findings indicate persistent underreporting, a predominance of young female victims, and insufficient allocation of state resources for trafficking prevention. The article concludes that criminal regulation constitutes a set of real-incidence decisions aimed at reducing social risks, and that Brazil fails to comply with its international and constitutional obligations by not prioritizing women's protection within its public security strategies
